Abuja, May 25, 2023 – The Appeal Court in Abuja on Thursday dismissed a suit seeking to stop the inauguration of the President-elect, Bola Ahmed Tinubu, on May 29
The suit was filed by Chief Ambrose Albert Owuru, the presidential candidate of the Hope Democratic Party (HDP) in the 2019 elections, against President Muhammadu Buhari, the Attorney-General of the Federation, INEC and Tinubu.
The appellant alleged that he won the 2019 election and that the Supreme Court wrongly dismissed his case against Buhari’s re-election for being statute-barred without looking at the substance of his case at the time.
Tinubu’s lawyers, however, urged the court to dismiss the suit and reaffirm the decision of the Federal High Court which initially dismissed the claims for being baseless.
On Thursday, the three-man panel of the court, led by Justice Jamil Tukur, held that the suit was frivolous and an abuse of the court process.
The court held that the Supreme Court had passed its verdict and there was no basis for the appellant to return to the court with the same allegation.
The court imposed N10 million fine on the appellant to be paid to each respondent. (GBN)
